"PROBLEMA NA CONCEITUAÇÃO DE LEI EM JEREMY BENTHAM:” PODE SER JUSTIFICADA A PUNIÇÃO LEGAL?
Resumo
Neste texto se investiga a forma como um projeto ético que propõe a minimização do sofrimento justifica a punição legal. Nesse sentido, a proposta de J. Bentham é examinada com o intuito de demonstrar que embora ele consiga estabelecer as bases para a construção de um sistema de punições mínimas, contudo ele não fornece critérios para avaliar o sucesso desse sistema. Como conclusão o autor argumenta que nem sempre o sofrimento mínimo é o sofrimento justo. Isto é, sem uma teoria da justiça o utilitarismo de Bentham não seria suficiente para oferecer uma justificativa para aqueles que não se satisfazem com o sofrimento mínimo que o próprio sistema de punições úteis produz.
