Abstract
The present study aims to discuss the application of the Risk Theory and the 14th article of the Consumer Rights Code regarding hospital activities. Under the author analysis, the application of the rules which deal with the Risk Theory, must consider if the professional activity implies risk to other ones and also if the application of these rules emanate from a specific regulation of the
health field
